सुप्रीम कोर्ट का केंद्र को बड़ा झटका, कहा- ब्याज माफी पर 7 दिन में करें स्थिति साफ

लोकडाउन के दौरान लोन मोरेटोरियम मुकदमे में सुप्रीम कोर्ट ने केंद्र सरकार को जवाब देने को कहा है। लोन मटेरियल अवधि में यह EMI पर ब्याज में छूट का मामला है। आज इस मामले में सुप्रीम कोर्ट में सुनवाई के दौरान केंद्र सरकार से इस मामले में 1 सितंबर तक अपना स्पष्टीकरण देने को कहा है। सुप्रीम कोर्ट ने कहा कि लोगों की परेशानियों की चिंता छोड़कर आप सिर्फ बिजनेस के बारे में नहीं सोच सकते हैं। सरकार आरबीआई के फैसले की आज ले रही है ,जबकि उसके पास खुद फैसला लेने का अधिकार है। डिजास्टर मैनेजमेंट एक्ट के तहत सरकार बैंकों को ब्याज पर ब्याज वसूलने से रोक सकती है।

इस पर जस्टिस अशोक भूषण की अध्यक्षता वाली पीठ ने कहा कि केंद्र ने इस मुकदमे पर अपना कोई स्पष्टीकरण नहीं किया है। जबकि आपका प्रबंधक अधिनियम के तहत उसके पास वह पर्याप्त सारी शक्तियां थी और वो ‘आरबीआई के पीछे छुप रही है। जस्टिस भूषण की बेंच ने यह भी कहा कि ऐसा इसलिए हुआ क्योंकि आपने पूरे देश को लॉकडाउन में डाल दिया था। आपको हमें दो चीजों पर अपना रुख साफ करके बताना होगा कि आपदा प्रबंधक कानून पर और क्या ईएमआई पर ब्याज लगेगा।
कोरोना और लोक डाउन की वजह से आरबीआई ने मार्च में लोगों को लोन की ईएमआई 3 महीने के लिए उसमें छूट गई थी। साथ में इसे 3 महीने से आगे बढ़ाकर 31 अगस्त तक के लिए कर दिया गया था। इस पर आरबीआई ने कहा था कि लोन की इंस्टॉलमेंट 6 महीने आपको नहीं चुकानी पड़ेगी। इसके बावजूद आपको डिफॉल्ट नहीं किया जाएगा। लेकिन मोरटोरियम के बाद बकाया पेमेंट पर पूरा ब्याज आपको देना पड़ेगा।
