PM Cares Fund: सुप्रीम कोर्ट ने कहा- जमा हुए पैसे को NDRF में ट्रांसफर करने का आदेश नहीं दे सकते
पीएम केयर्स फंड का पैसा नेशनल डिजास्टर रेस्पॉन्स फंड (एनडीआरएफ) में ट्रांसफर करने का आदेश हम नहीं दे सकते। ये दोनों फंड अलग-अलग हैं। कोई भी व्यक्ति एनडीआरएफ में दान देना चाहे तो उस पर पाबंदी नहीं लगाई जा सकती है। किसी नई आपदा राहत योजना की भी जरूरत नहीं है।'

पीएम केयर्स फंड में जमा हुए पैसे को राष्ट्रीय आपदा राहत कोष (NDRF) में ट्रांसफर करने का आदेश देने से सुप्रीम कोर्ट ने साफ मना कर दिया है। पीएम केयर्स फंड के मामले में आज सुप्रीम कोर्ट ने फैसला सुनाया। जस्टिस अशोक भूषण की अध्यक्षता वाली 3 जजों की बेंच ने कहा, ‘पीएम केयर्स फंड का पैसा नेशनल डिजास्टर रेस्पॉन्स फंड (एनडीआरएफ) में ट्रांसफर करने का आदेश हम नहीं दे सकते। ये दोनों फंड अलग-अलग हैं। कोई भी व्यक्ति एनडीआरएफ में दान देना चाहे तो उस पर पाबंदी नहीं लगाई जा सकती है। किसी नई आपदा राहत योजना की भी जरूरत नहीं है।’
सेंटर फॉर पब्लिक इंटरेस्ट लिटिगेशन (सीपीआईएल) एनजीओ ने इस मामले में अपनी पिटीशन लगाई थी। सीपीआईएल ने कहा था, ‘पीएम केयर्स फंड बनाकर सरकार ने आपदा प्रबंधन कानून की अनदेखी करी है। आपदा प्रबंधन के लिए किसी भी व्यक्ति विशेष या संस्था से दान में मिलने वाली धन राशि नेशनल डिजास्टर रेस्पॉन्स फंड (एनडीआरएफ) के अकाउंट में ही जानी चाहिए। पीएम केयर्स फंड में जो भी धन राशि मिली है, उसे एनडीआरएफ में ही ट्रांसफर किया जाए। कोरोना से निपटने के लिए डिजास्टर मैनेजमेंट एक्ट के तहत यह नई योजना बनाकर नोटिफाई की जाए।’

सरकार ने 28 मार्च को पब्लिक चैरिटेबल ट्रस्ट के तौर पर इस फंड को बनाया था। इसका उद्देश्य कोरोना जैसी महामारी से निपटने के इंतजाम करना था। कोरोना काल में कॉरपोरेट से लेकर इंडिविजुअल तक ने इस फंड मेंदान दिया गया था।
इस फंड पर क्यों उठे सवाल ?
सीपीआईएल एनजीओ का कहना था कि डिजास्टर मैनेजमेंट एक्ट की धारा 46 के तहत नेशनल डिजास्टर रेस्पॉन्स फंड में दान की धन राशि जमा करने की व्यवस्था है, तो कोरोना से लड़ाई के लिए मिलने वाली धन राशि पीएम केयर्स फंड में जमा क्यों करवाई जा रही है? पीएम केयर्स फंड का कैग से ऑडिट क्यों नहीं करवाया जा रहा। कांग्रेस नेता राहुल गांधी ने भी इस फंड पर सवाल उठाते हुए कहा था कि इस फंड में दान देने वालों का नाम बताने से प्रधानमंत्री इतना डर क्यों रहे हैं?
सरकार ने क्या कहा?
सरकार द्वारा 8 जुलाई को सुप्रीम कोर्ट में एफिडेविट दिया था। सरकार का कहना था कि कोरोना से राहत के कार्यो को करने के लिए पीएम केयर्स फंड बनाया गया था। पहले भी ऐसे कई फंड बनाए जाते रहे हैं। एनडीआरएफ जैसा संवैधानिक फंड होने का मतलब यह नहीं है कि वॉलेंटरी डोनेशन के लिए पीएम केयर्स जैसे दूसरे फंड नहीं बनाए जा सकते। सॉलिसिटर जनरल तुषार मेहता ने दलील दी थी कि पीएम केयर्स फंड बनाने का मकसद एनडीआरएफ को फेल करना नहीं था, जैसा कि पिटीशनर ने आरोप लगाया है।
