केंद्रीय जांच एजेंसी ने फेमा के तहत इस आधार पर जांच शुरू की थी कि एमनेस्टी इंटरनेशनल यूके विदेशी योगदान विनियमन अधिनियम (एफसीआरए) से बचने के लिए प्रत्यक्ष विदेशी निवेश (एफडीआई) के माध्यम से अपनी भारतीय संस्थाओं के माध्यम से बड़े पैमाने पर विदेशी योगदान दे रहा था।
नई दिल्ली/जीजेडी न्यूज: प्रवर्तन निदेशालय ने शुक्रवार को एमनेस्टी इंटरनेशनल इंडिया और उसके पूर्व मुख्य कार्यकारी अधिकारी (सीईओ) आकार पटेल को विदेशी मुद्रा प्रबंधन अधिनियम (फेमा) के उल्लंघन के आरोप में कारण बताओ नोटिस जारी किया। जांच एजेंसी ने एमनेस्टी इंटरनेशनल पर 51.72 करोड़ रुपये और पटेल पर 10 करोड़ रुपये का जुर्माना लगाया है।
केंद्रीय जांच एजेंसी ने फेमा के तहत इस आधार पर जांच शुरू की थी कि एमनेस्टी इंटरनेशनल यूके विदेशी योगदान विनियमन अधिनियम (एफसीआरए) से बचने के लिए प्रत्यक्ष विदेशी निवेश (एफडीआई) के माध्यम से अपनी भारतीय संस्थाओं के माध्यम से बड़े पैमाने पर विदेशी योगदान दे रहा था।
ईडी के बयान में कहा गया है कि ये फंड कथित तौर पर केंद्रीय गृह मंत्रालय द्वारा एफसीआरए के तहत संगठन और एमनेस्टी इंडिया फाउंडेशन ट्रस्ट और अन्य ट्रस्टों को पूर्व पंजीकरण या अनुमति से इनकार करने के बावजूद भारत में एनजीओ गतिविधियों का विस्तार करने के लिए प्राप्त किया गया था।
कारण बताओ नोटिस के अनुसार, नवंबर 2013 और जून 2018 के बीच एमनेस्टी इंटरनेशनल इंडिया द्वारा प्राप्त प्रेषण और व्यापार परामर्श और पीआर सेवाओं के लिए रसीद के रूप में दावा किया गया, विदेशी योगदानकर्ता से उधार के अलावा कुछ भी नहीं है, जिससे फेमा का स्पष्ट उल्लंघन होता है।
ईडी ने कहा कि एमनेस्टी इंटरनेशनल इंडिया से विस्तृत जवाब मिलने के बाद प्रधान न्यायाधीश का पालन करने पर, जांच एजेंसी के निर्णायक प्राधिकरण ने माना कि एआईआईपीएल उन गतिविधियों में शामिल है जो उनके घोषित वाणिज्यिक व्यवसायों के लिए प्रासंगिक नहीं हैं और मॉडल ने उनके लिए आवेदन किया है। एफसीआरए की जांच से बचने के लिए कारोबारी गतिविधियों की आड़ में विदेशी फंड का इस्तेमाल करते हैं।
ईडी के बयान में कहा गया है, “एमनेस्टी इंटरनेशनल को सेवाओं के निर्यात के लिए प्रेषण के दावे के संबंध में एआईआईपीएल के सभी तर्कों और प्रस्तुतियों को ठोस सबूतों के अभाव में खारिज कर दिया गया है।”
