लखीमपुर खीरी हिंसा मामला : यूपी एसआईटी ने दायर की 5,000 पन्नों की चार्जशीट; केंद्रीय मंत्री के बेटे आशीष मिश्रा को बनाया मुख्य आरोपी
एसआईटी जांच अधिकारी विद्याराम दिवाकर ने सीजेएम की अदालत में आईपीसी की धारा 279, 338 और 304 ए की जगह वारंट में नई धाराएं जोड़ने के लिए आवेदन दायर किया।
नई दिल्ली: लखीमपुर खीरी में हुई हिंसा में चार किसानों समेत 8 लोगों की मौत के तीन महीने बाद विशेष जांच दल ने मामले में चार्जशीट दाखिल की है। एसआईटी ने केंद्रीय राज्य मंत्री (MoS) अजय मिश्रा टेनी के बेटे आशीष मिश्रा को मुख्य आरोपी के रूप में नामित करते हुए मामले में 5000 पन्नों का आरोप पत्र दायर किया है। जांच टीम ने मामले में 16 आरोपियों को नामजद किया है। अभियोजन पक्ष के वकील ने यह भी कहा, “एक और व्यक्ति वीरेंद्र शुक्ला का नाम चार्जशीट में जोड़ा गया है। उस पर आईपीसी की धारा 201 के तहत आरोप लगाया गया है। वीरेंद्र शुक्ला आशीष मिश्रा के करीबी हैं।
दिसंबर में, एसआईटी ने मुख्य न्यायिक मजिस्ट्रेट (सीजेएम) के समक्ष एक आवेदन दायर किया था जिसमें आशीष मिश्रा सहित 13 आरोपियों के खिलाफ हत्या के प्रयास के आरोपों के तहत उनके अपराध को दंडनीय बनाने के लिए नई धाराएं शामिल की गई थीं।
एसआईटी जांच अधिकारी विद्याराम दिवाकर ने सीजेएम की अदालत में आईपीसी की धारा 279, 338 और 304 ए की जगह वारंट में नई धाराएं जोड़ने के लिए आवेदन दायर किया।
अपने आवेदन में, जांच अधिकारी ने बताया कि घटना सुनियोजित और एक जानबूझकर किया गया कार्य था, न कि लापरवाही या लापरवाही का। जांच अधिकारी ने धारा 279 को बदलने के बाद भारतीय दंड संहिता की धारा 307 (हत्या का प्रयास), 326 (खतरनाक हथियारों या साधनों से स्वेच्छा से गंभीर चोट पहुंचाना), 34 (सामान्य इरादे से कई व्यक्तियों द्वारा किए गए कार्य) को जोड़ने का अनुरोध किया था। (सार्वजनिक रास्ते पर तेज गति से वाहन चलाना या सवारी करना), 338 (जो कोई इतनी जल्दबाजी या लापरवाही से किसी भी व्यक्ति को गंभीर चोट पहुंचाता है) और 304A (लापरवाही से मौत का कारण) IPC।
घटना 3 अक्टूबर 2021 को उत्तर प्रदेश के लखीमपुर खीरी जिले के तिकुनिया गांव की है। एक वाहन द्वारा कथित रूप से कुचले जाने के बाद चार किसानों और एक पत्रकार की मौत हो गई। गुस्साई भीड़ द्वारा जवाबी कार्रवाई में भाजपा के तीन कार्यकर्ताओं की भी मौत हो गई।
नवंबर में सुप्रीम कोर्ट ने एसआईटी का पुनर्गठन किया था और नए सदस्यों को जोड़ा था, आईपीएस अधिकारी एस.बी. शिराडकर, प्रीतिंदर सिंह, और पद्मजा चौहान, पंजाब और हरियाणा उच्च न्यायालय के सेवानिवृत्त न्यायाधीश राकेश कुमार जैन के साथ, लखीमपुर खीरी हिंसा की जांच करने के लिए।
