पंजाब नेशनल बैंक धोखाधड़ी मामला: डोमिनिका की अदालत ने चोकसी को जमानत देने से किया इनकार : स्थानीय मीडिया
डोमिनिका के एक मजिस्ट्रेट ने भगोड़े हीरा कारोबारी मेहुल चोकसी को जमानत देने से इनकार कर दिया। स्थानीय मीडिया में यह जानकारी दी गई है। चोकसी को कैरिबियाई द्वीपीय देश में कथित तौर पर अवैध रूप से प्रवेश करने के लिए 23 मई को गिरफ्तार कर लिया गया था।

‘डोमिनिका न्यूज ऑनलाइन’ की खबर के अनुसार, पंजाब नेशनल बैंक (पीएनबी) में 13,500 करोड़ रुपये के धोखाधड़ी मामले में वांछित चोकसी ने मजिस्ट्रेट के समक्ष कहा कि उसका अपहरण किया गया था और उसे पड़ेासी देश एंटीगुआ तथा बारबुडा से जबरन डोमिनिका लाया गया। व्हीलचेयर पर बैठा, 62 वर्षीय चोकसी काले रंग की निकर और नीले रंग की टी-शर्ट पहने हुए पीठासीन रोसियू मजिस्ट्रेट की अदालत में पेश हुआ। उसे डोमिनिका चाइना फ्रेंडशिप हॉस्पिटल से अदालत लाया गया। इसी अस्पताल में उसका इलाज चल रहा है।
चोकसी की बंदी प्रत्यक्षीकरण याचिका पर सुनवाई कर रहे डोमिनिका उच्च न्यायालय ने अवैध प्रवेश के आरोपों का सामना करने के लिए उसे मजिस्ट्रेट के समक्ष पेश करने का आदेश दिया। बंदी प्रत्यक्षीकरण याचिका ऐसे व्यक्ति को अदालत में पेश करने के लिए दायर की जाती है जो गिरफ्तार है या अवैध रूप से हिरासत में है।
चोकसी के वकील विजय अग्रवाल ने क्या कहा
चोकसी के वकील विजय अग्रवाल ने यहां कहा, ‘‘हमारा कहना है कि मेहुल चोकसी अवैध हिरासत में है इसलिए उसे 72 घंटों के भीतर मजिस्ट्रेट के समक्ष पेश करने की आवश्यकता है। इसे सुधारने के लिए उसे मजिस्ट्रेट के समक्ष पेश होने के लिए कहा गया है। यह साबित करता है कि चोकसी को अवैध हिरासत में रखा गया। विभिन्न मीडिया खबरों के उलट भारत सरकार के संबंध में कोई चर्चा नहीं की गई।’’ मजिस्ट्रेट कैंडिया कैरेट जॉर्ज के समक्ष सुनवाई के दौरान डोमिनिका के अभियोजक ने चोकसी को हिरासत में रखने के लिए दो मुख्य दलीलें दी।
लोक अभियोजक शेरमा डैलरिम्पल ने अदालत को बताया कि चोकसी के ‘‘भागने का खतरा है’’ और डोमिनिका में उसके लिए ऐसी कोई वजह नहीं है जो जमानत मिलने पर उसे देश से भागने से रोक सके।
बचाव पक्ष के वकील वायने नोर्डे ने कहा कि चोकसी की सेहत को देखते हुए उसके भागने का खतरा नहीं है और एंटीगुआ तथा बारबुडा में लंबित प्रत्यर्पण की कार्यवाही भी उसके डोमिनिका छोड़कर न जाने की एक वजह है।
नोर्डे ने कहा कि चोकसी पर एंटीगुआ तथा बारबुडा में कोई आपराधिक मामला नहीं है और उसके खिलाफ कार्यवाही दीवानी प्रकृति की है जो दिखाती है कि वह अच्छे चरित्र वाला व्यक्ति है।
वकील ने कहा कि जमानत का नया कानून कहता है कि बचावकर्ता को तब तक राहत मिलने का अधिकार है जब तक कि अपराध गंभीर प्रकृति का न हो।
मजिस्ट्रेट ने अपने आदेश में कहा कि ‘‘मामले की जटिलता’’ को देखते हुए वह इससे संतुष्ट नहीं है कि चोकसी कानूनी कार्रवाई का सामना करने के लिए देश में रहेगा। इसके साथ ही मजिस्ट्रेट ने मामले पर सुनवाई 14 जून तक स्थगित कर दी।
